Clear Responsibilities at Every Stage
At ePresence Digital Marketing, our responsibilities under GDPR depend on the nature of our engagement with you. In some situations, we determine how data is collected and used; in others, we act strictly under your instruction.
When We’re the Data Controller
In managing our own business including marketing our services, running events, responding to enquiries, or issuing proposals – we act as a data controller. This means we make decisions about how personal data is handled for the purpose of growing and managing ePresence.
When We’re the Data Processor
When we’re delivering services on your behalf, such as managing your advertising accounts, running campaigns, or handling customer data as part of our work for you – we act as a data processor. In these cases, we only use the data in line with your instructions and as required to provide the agreed services.

Clear Agreements from the Start
When you begin working with ePresence, you’ll receive an Order Confirmation that includes links to our Client Services Agreement and our Data Processing Agreement (DPA).
Our DPA meets the requirements set out in Article 28 of the GDPR and clearly defines our responsibilities - including our commitment to follow your instructions, maintain confidentiality, safeguard data, and support your compliance with applicable regulations.
If you'd like to review a sample DPA during the sales process, we’re happy to provide it.
Robust Security Measures
We apply a strong set of technical and organisational safeguards to protect the personal data we handle on your behalf. These measures are designed to ensure secure, consistent, and compliant service delivery.
Key protections include:
- Use of encrypted devices by all team members
- Mandatory two-factor authentication on all operational systems where available
- Secure, cloud-based file storage with structured client directories
- Client data stored separately and systematically
- Regular backups to encrypted cloud storage
Prompt Incident Response
In the unlikely event of a data incident affecting personal data we manage for you, our policy is to alert you without delay.
We will work with you to investigate and respond, following procedures that are also used when managing incidents on behalf of our clients.
Where needed, we’ll support your reporting obligations to the relevant Data Protection Authority in cases where the issue is deemed reportable under GDPR.
Handling Data Subject Requests
If we receive a request from an individual regarding their personal data - such as access, correction, or deletion - we will first determine if that is data that we manage on your behalf.
When it is, we’ll notify you as soon as possible and assist you in responding within the time limits set out by the GDPR.
Our role is to support you in fulfilling your obligations while ensuring requests are handled promptly and appropriately.
